The general terms and conditions apply as basic regulations unless otherwise agreed.

1. Scope of application

The following “General Terms and Conditions” are from now on referred to as “GTC”. They shall apply to all business relations (including consultations and other services) between the store and the customer in the version valid at the time of the order. Deviating terms and conditions shall only apply if and to the extent that they have been confirmed in writing.

2. Flower information

Flowers are a seasonal product. Therefore, the whole variety is not always available. Accordingly, the bouquets shown are adapted to the season. We cannot always guarantee that the individual flowers will be available at all times, especially during last-minute orders. A bouquet may therefore look slightly different in person than in the picture. But each bouquet is a work of art, individually and freshly assembled and as close as possible to the image in shape and color.

3. Prices

Price adjustments for products and services are possible anytime, as flower prices are naturally subject to seasonal and regional fluctuations. Only the prices stated in the order confirmation or the store are valid. In the event of changes or cancellations of orders by the customer, costs for this may be charged.

4. Value-added tax

The prices stated by us are all-inclusive of value-added tax.

5. Delivery conditions

5.1 Delivery date

The delivery takes place in principle on the desired day. Exceptions: Sundays and public holidays. Due to legal regulations, no deliveries can be made on Sundays and public holidays.

Mother’s Day orders are usually executed on the Saturday before Mother’s Day. Orders placed after 4 p.m. on Saturday may not be delivered until Monday. If Valentine’s Day (Feb. 14) falls on a Sunday, orders can be delivered as early as Saturday, Feb. 13. This way, Bellefleur Fleuriste GmbH can guarantee the most efficient and successful execution of all Valentine’s Day orders even in such years.

5.2 Delivery of the flower order

If the recipient cannot be found at the delivery address, the flower courier will try to deliver the flower order to a third person who seems suitable to forward it to the recipient (e.g. neighbor, receptionist, funeral home, etc.). If this is unsuccessful, he/she will return the flowers and leave a notification card.

5.3 Deliveries for special occasions and events

In the case of deliveries for special events, these shall be made by the respective order confirmation. Unless otherwise agreed, the store’s service also includes clearing and removing the decoration unless the customer wants to take it away himself.

5.4 Correctness of the delivery address

Please ensure that the delivery address, including the telephone number given to us, is correct and complete. We cannot accept liability for delays or non-deliveries due to incorrect or incomplete addresses. In case of redelivery, the delivery charges will be charged additionally.

5.5 Hospital delivery and hotel delivery

For hospital deliveries, please indicate department and room number if possible. In the case of hotel deliveries, please indicate the room number and the name under which the recipient is registered in the hotel (group, couple, etc.).

6. Payments

6.1 Payments by invoice

Payments by invoice must be settled net within ten (10) days from the invoice date. The store reserves the right to make deliveries to new customers or, in justified individual cases, against cash on delivery or advance payment.

6.2 Default of payment

In case of delayed or deferred payment, the store is entitled to charge interest at the legal rate, but at least 5% p.a., as well as reminder fees of CHF 30.– per case; the right to claim further costs is reserved. Depending on creditworthiness, subject matter, and contract volume, the store reserves the right to request a different payment method or additional security for the advance payment. For larger orders of CHF 2,000.– or more, the store may require a down payment of at least 50%.

7. Procurement problems 

In case of unforeseen unavailability of the ordered goods, the store reserves the right to deliver equivalent goods. 

8. Warranty

The store guarantees a minimum shelf life of 4 days for the fresh cut flowers, provided that the customer gives the cut flowers proper care and provides sufficient water. Any liability is excluded for other deliveries.

9. Data protection

For Bellefleur Fleuriste GmbH, the protection of your privacy has absolute priority. We are committed to providing you with the highest level of privacy and security. We use your data only to process your orders. Your email address and personal data will be treated confidentially and will not be passed on to third parties. In our online store, the order is processed via an order form. This information is used for the delivery of your order, order confirmation, and – if necessary – for further inquiries. However, they are not intended to be traded. Your credit card details are not stored. They are transmitted directly to the credit card companies via an encrypted connection at the end of an order process and validated.

10. Public holidays

Our flower store will be closed on the following public holidays: Good Friday, Easter Monday, Ascension Day, Corpus Christi, Whit Monday, Swiss National Day, Assumption Day, All Saints’ Day, Immaculate Conception Day, Christmas: December 25/26, New Year: January 1-2.

12. Place of jurisdiction and applicable law

Swiss law is applicable. The place of jurisdiction is the registered office of the store.
